Terms of sale
The short version: buy it once, keep your data, change your mind within 30 days.
Who you are buying from
CacheYourBrain is sold by GMA Software Limited (NZBN [NZBN — SET ME]), of 93 Glenvar Road, Torbay, Auckland 0630, New Zealand ("we", "us"). Contact: support@gma-software.com.
Payments are processed by Paddle, who act as the merchant of record and seller for the transaction. Your receipt, invoice and card statement will show Paddle. Tax or GST is calculated and remitted by Paddle.
What you are buying
A personal licence to use the Pro features of CacheYourBrain, delivered as a licence key. It is a one-time purchase, not a subscription. Nothing renews automatically and we do not store your card details.
- Pro includes twelve months of updates from the date of purchase. Renewal is optional.
- Founder's Edition includes updates for as long as CacheYourBrain is sold. It excludes future add-on packs and hosted services, which founders receive at a 30% discount.
Keeping what you paid for
Every Pro feature released while your updates were active remains available to you, permanently, in every future version. Pro features released after your updates period ends require a renewal. Bug fixes and free features continue to reach everyone.
Because CacheYourBrain updates itself in your browser, we cannot promise you a frozen historical version. This clause is how we keep the spirit of that promise instead.
How you may use it
- The licence names one person. That person may use it on as many of their own devices and browsers as they like, personally or at work.
- Teams buy one licence per person.
- Please don't publish your key. Keys that are posted publicly are revoked and re-issued to the owner.
- You may not resell, sublicense or redistribute the licence key.
Your data is yours
Your notes and databases live on your own device. No licence state ever blocks access to your data, and export is always free — including after a refund, an expiry, or if we cease trading.
If we stop
If CacheYourBrain is discontinued, Founder's Edition holders receive a final build that continues to work without any licence check.
Warranty and liability
The software is provided "as is". Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other law that cannot lawfully be excluded. Where liability can lawfully be limited, ours is limited to the amount you paid for the licence.
If you acquire the software for business purposes, the Consumer Guarantees Act does not apply to that supply.
You are responsible for your own backups. Keep them.
Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction.
Changes
We may update these terms for future purchases. The terms you bought under continue to apply to that purchase.
